Enduring Power of Attorney

An Enduring Power of Attorney is a document that nominates a decision maker (called an “Attorney”) to make decisions regarding your legal and financial affairs in the event you do not wish or are not able to make such decisions for yourself. 

The principal advantage to the preparation of an EPA is that you control who receives the power to govern your affairs.  In the absence of an EPA you are left with the possibility of the Public Trustee assuming control over your finances or a complicated court process to select a trustee.  Either option is fraught with additional legal costs and emotional turmoil which can easily be avoided with the creation of an EPA.
